We zorgen er natuurlijk voor dat alle bestellingen met de grootste zorg worden verwerkt en verzonden. Natuurlijk is het helaas wel eens mogelijk dat er wat misgaat. Dan kan zijn doordat iets verkeerd in pakketje gaat of in het bezorg proces iets misloopt.

Algemene voorwaarden
Marvin Dee Band heeft de Algemene Verkoop-, Leverings- en Betalingsvoorwaarden van MITEX (Nederlandse Vereniging van Detailhandelaren in de Modebranche) vastgesteld. De algemene voorwaarden MITEX zijn in december 2002 tot stand gekomen in overleg met de Consumentenbond in het kader van de CZ (Coördinatiegroep Zelfregulering) van de SER en zijn in werking getreden op 1 januari 2003.
Artikel 1: Toepassingsgebied
1. Deze algemene voorwaarden (hierna: de algemene voorwaarden) zijn van toepassing op alle overeenkomsten, leveringen en andere diensten die tussen de klant en Marvin Dee Band worden overeengekomen
2. Door het plaatsen van een bestelling gaat de klant akkoord met de algemene voorwaarden.
3. Tenzij Marvin Dee Band schriftelijk anders heeft aangegeven aan de klant, worden de eigen algemene voorwaarden van de klant niet geaccepteerd.
Artikel 2: Aangaan van een overeenkomst
1. Marvin Dee Band bevestigt de bestelling van de klant per e-mail. In afwijking van artikel 4.1 van de algemene voorwaarden van MITEX komt een overeenkomst pas tot stand wanneer de betaling succesvol is uitgevoerd. Marvin Dee Band is gerechtigd een levering te weigeren of bijzondere voorwaarden op te leggen mits opgaaf van redenen. Als Marvin Dee Band het (tijdelijke) adres van de klant niet duidelijk kan vaststellen, kan een bestelling niet worden geaccepteerd.
2. Orderprocessen die om welke reden dan ook technisch of anderszins zijn verstoord voordat de betalingsinstructies zijn voltooid, zijn onvolledig, zelfs als de klant een orderbevestiging heeft ontvangen. Een dergelijke bestelling zal dus in principe niet geleverd worden. Marvin Dee Band zal zich echter inspannen om contact op te nemen met de klant om de betalingsinstructies in te vullen zodat de levering kan plaatsvinden.
Artikel 3: Prijzen en kosten
De contractprijs is de actuele prijs op het moment dat er een bestelling wordt geplaatst bij de webshop. De prijzen van artikelen zijn inclusief BTW (21%).
2. De in de webshop vermelde prijzen zijn exclusief verzendkosten en administratiekosten.
3. Marvin Dee Band is niet gebonden aan de voorwaarden van haar aanbieding in het geval van een druk-, zet- of programmeerfout op haar website.
Artikel 4: Uitvoeren van bestellingen
1. Marvin Dee Band zal de grootst mogelijke zorgvuldigheid in acht nemen bij het verwerken van bestellingen van artikelen.
2. Artikelen worden geleverd op het door de klant aan Marvin Dee Band opgegeven adres.
3. Marvin Dee Band zal geaccepteerde bestellingen zo spoedig mogelijk verzenden in de volgorde waarin ze zijn ontvangen.
4. De op de webshop aangegeven leveringstermijn geldt slechts bij benadering en er bestaat geen recht op schadevergoeding indien de feitelijke levering langer duurt.
Artikel 5: Douane, heffingen en belastingen
1. De klant is verantwoordelijk om ervoor te zorgen dat het product rechtmatig kan worden geïmporteerd in het land van bestemming. Wanneer u bestelt bij Marvin Dee Band, is de ontvanger de geregistreerde importeur en moet hij voldoen aan alle wet- en regelgeving van het land van bestemming. Bestellingen die worden verzonden naar landen buiten de Europese Unie kunnen onderhevig zijn aan invoerbelastingen, douanerechten en toeslagen die door het land van bestemming worden geheven. De ontvanger van een internationale zending kan onderworpen zijn aan dergelijke invoerbelastingen, douanerechten en toeslagen, die worden geheven zodra een zending uw land bereikt. Extra kosten voor inklaring zijn voor rekening van de ontvanger; Marvin Dee Band heeft geen controle over deze beschuldigingen en kan niet voorspellen wat ze kunnen zijn.
2. Het is misschien een goed idee om contact op te nemen met uw lokale douanekantoor voor actuele kosten voordat u bestelt, zodat u niet verrast wordt door kosten die u niet had verwacht.
Artikel 6: Recht om artikelen te retourneren
1. In afwijking van artikel 5 van de algemene voorwaarden van MITEX heeft de klant het recht om elk artikel binnen veertien (14) dagen na levering aan Marvin Dee Band te retourneren, zonder opgaaf van reden. U krijgt de waarde van het/de product(en) terug. Retourkosten zijn voor eigen rekening.
2. Er vindt geen restitutie plaats van artikelen die na de genoemde periode van veertien dagen aan Marvin Dee Band worden geretourneerd.
3. Artikelen dienen te worden geretourneerd volgens de instructies op de pakbon die bij de artikelen is gevoegd.
4. Artikelen die worden geretourneerd, moeten in de staat zijn die algemeen wordt geaccepteerd voor normaal gebruik voor goedkeuring van de artikelen, zoals het passen van artikelen in conventionele winkels. Indien een klant gebruik wenst te maken van dit recht om een artikel terug te sturen, dient het artikel samen met alles wat er oorspronkelijk mee is verzonden, in de originele staat en verpakking aan Marvin Dee Band te worden geretourneerd, in overeenstemming met de duidelijke en redelijke instructies van Marvin Dee Band.
5. Marvin Dee Band heeft het recht een geretourneerd artikel te weigeren of terug te sturen naar de klant als het artikel gebruikt lijkt te zijn, niet meer de originele labels draagt, of schade aan het licht brengt die door de klant is veroorzaakt, of als de klant dit niet doet. volg de instructies van Marvin Dee Band voor het retourneren van het artikel.
6. Als Marvin Dee Band om welke reden dan ook niet binnen dertig (30) dagen levert, heeft de klant recht op volledige terugbetaling, zonder kosten.
Artikel 7: Fout in levering
Indien Marvin Dee Band een ander artikel levert dan het bestelde, of indien het artikel beschadigd of defect is, dient de klant Marvin Dee Band hiervan zo spoedig mogelijk op de hoogte te stellen. Marvin Dee Band vergoedt de aankoopprijs plus portokosten.
Artikel 8: Klachten
Als een klant een artikel wil ruilen of retourneren, moet hij de instructies volgen die zijn vermeld op de pakbon die bij het artikel is gevoegd.
Overige vragen, opmerkingen of klachten met betrekking tot een bestelling, betaling of levering dienen schriftelijk te worden gericht aan het volgende e-mailadres: info@marvindeeband.nl.
Het e-mailbericht moet de naam van de klant bevatten, het e-mailadres dat overeenkomt met dat in de Marvin Dee Band-administratie, het ordernummer dat in de orderbevestiging staat en het artikelnummer.
Artikel 9: Minimumleeftijd
Een bestelling wordt door Marvin Dee Band niet geaccepteerd van iemand jonger dan 16 jaar
Artikel 10: Betaling
1. De klant kan ofwel via overschrijving betalen.
2. Alle betalingen dienen te geschieden in overeenstemming met de instructies op de pagina’s van de webshop.
Artikel 11: Algemeen
We kunnen van tijd tot tijd de voorwaarden wijzigen die van toepassing zijn op het gebruik van onze site. Uw gebruik van onze site na een dergelijke wijziging houdt in dat u ermee instemt de gewijzigde voorwaarden te volgen en hieraan gebonden te zijn. We kunnen van tijd tot tijd delen van onze site wijzigen, verplaatsen of verwijderen, of er iets aan toevoegen.
Artikel 12: Productinformatie
Alle ontwerpen zijn eigendom van Marvin Dee Band en mogen niet worden hergebruikt of herdrukt zonder uitdrukkelijke toestemming. We hebben er alles aan gedaan om de kleuren van onze producten die op de site verschijnen zo nauwkeurig mogelijk weer te geven. De werkelijke kleur die u ziet, is echter afhankelijk van uw monitor.
Artikel 13: productbeschikbaarheid
Hoewel de beschikbaarheid op de site kan worden aangegeven, kunnen we de productbeschikbaarheid niet garanderen en is het mogelijk dat producten niet beschikbaar zijn voor onmiddellijke levering of helemaal niet beschikbaar zijn. We behouden ons het recht voor om zonder aansprakelijkheid of voorafgaande kennisgeving een of alle producten te herzien, stop te zetten of niet langer beschikbaar te stellen of om een bestelling te annuleren. Als er een herziening, stopzetting of stopzetting is, kunnen we naar eigen goeddunken producten verzenden die in wezen dezelfde functionaliteit en specificaties hebben als de bestelde producten, of uw bestelling annuleren.

Marvin Dee Band has adopted the General Terms and Conditions of Sale, Delivery and Payment of MITEX (Dutch Association of Retail Traders in the Fashion Industry). The MITEX general terms and conditions were drawn up in December 2002 in consultation with the Dutch Consumer Association within the context of the CZ (Coordinating Group for Self-Regulation) of the SER (Social and Economic Council of the Netherlands) and came into effect on 1 January 2003. A copy of the MITEX general terms and conditions is set out at the end of these (additional) General Terms and Conditions of Marvin Dee Band
Article 1: Scope
1.These general terms and conditions (hereinafter: the general conditions) govern all contracts, supplies and other services agreed between the customer and Marvin Dee Band
2. By placing an order, the customer agrees to be bound by the general conditions.
3. Unless Marvin Dee Band has indicated otherwise in writing to the customer, the customer’s own general terms and conditions shall not be accepted.
Article 2: Entering into a contract
- Marvin Dee Band shall confirm the customer’s order by e-mail. Contrary to Article 4.1 of the MITEX general terms and conditions, a contract is created only when payment has been successfully made. Marvin Dee Band is entitled to refuse, or impose special conditions upon, a supply, subject to giving reasons. If Marvin Dee Band is unable to clearly establish the customer’s permanent or temporary address, an order cannot be accepted.
- Order processes that for whatever reason have been technically or otherwise disrupted before the payment instructions have been completed are incomplete, even if the customer has received an order confirmation. Such an order will in principle therefore not be delivered. Marvin Dee Band shall endeavour, however, to contact the customer to complete the payment instructions so that delivery can be made.
Article 3: Prices and costs
- The contract price is the current price at the moment when an order is placed with the webshop. The prices of articles are quoted inclusive of Dutch VAT (21%).
2. The prices quoted in the webshop are exclusive of postage and administration costs.
3. Marvin Dee Band is not bound by the terms of its offer in the event that there is any printing, typesetting or programming fault on its website.
Article 4: Fulfilling orders
- Marvin Dee Band shall act with the greatest possible care in processing orders for articles.
2. Articles shall be delivered to the address given by the customer to Marvin Dee Band.
3. Marvin Dee Band shall dispatch accepted orders as quickly as possible in the order in which they are received.
4. The on the webshop indicated delivery term is approximate only and there is no right to compensation if actual delivery takes longer.
Article 5: Customs, Duties and Taxes
- The customer is responsible for assuring that the product can be lawfully imported to the destination country. When ordering from Marvin Dee Band, the recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders that are shipped to countries outside the European Union may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by the recipient; Marvin Dee Band has no control over these charges and cannot predict what they may be.
- It might be a good idea to contact your local customs office for current charges before you order, so you are not surprised by charges you were not expecting.
Article 6: Right to return articles
- Contrary to Article 5 of the MITEX general terms and conditions the costumer is entitled to return any article to Marvin Dee Band within fourteen (14) days of its delivery, without need to give any reason. You will be refunded for the value of the product(s). Return costs are at own expense.
- No refund will be made in respect of articles returned to Marvin Dee Band after the said fourteen-day period.
- Articles must be returned in accordance with the instructions set out on the packing slip enclosed with the articles.
- Articles being returned must be in the condition generally accepted for normal use for approval of the articles, such as trying on articles in conventional shops. If a customer wishes to exercise such right to return an article, the article must be returned to Marvin Dee Band together with everything originally sent with it, in its original state and packaging, in accordance with the clear and reasonable instructions given by Marvin Dee Band.
- Marvin Dee Band is entitled to refuse to accept a returned article or to send it back to the customer if the article appears to have been used, no longer carries the original labels, or reveals damage caused by the customer, or if the customer does not comply with the instructions for returning the article given by Marvin Dee Band.
- If for any reason Marvin Dee Band does not deliver within thirty (30) days, the customer is entitled to a full refund, without any charge.
Article 7: Error in delivery
If Marvin Dee Band delivers an article different from the one ordered, or if the article is damaged or defective, the customer must notify Marvin Dee Bandof this as soon as possible. Marvin Dee Band shall reimburse the purchase price plus postage charge.
Article 8: Complaints
- If a customer wishes to exchange or return an article, it must follow the instructions specified on the packing slip enclosed with the article.
- Other queries, comments, or complaints relating to an order, payment, or delivery should be sent in writing to the following e-mail address:info@marvindeeband.nl.
- The e-mail message must contain the customer’s name, e-mail address corresponding with that in Marvin Dee Band records, the order number included in the order confirmation, and the article number.
Article 9: Minimum age
- An order will not be accepted by Marvin Dee Band from anyone under the age of 16
Article 10: Payment
1. The customer may pay either by bank transfer.
2. All payments must be made in accordance with the instructions given on the pages of the webshop.
Article 11: General
We may, from time to time, change the terms that govern use of our site. Your use of our site following any such change constitutes your agreement to follow and be bound by the terms as changed. We may change, move or delete portions of, or may add to our site from time to time.
Article 12: Product information
All designs are property of Marvin Dee Band and may not be reused or reprinted without express permission. We have made every effort to display as accurately as possible the colors of our products that appear on the site. However, the actual color you see will depend on your monitor.
Article 13: product availability
Although availability may be indicated on the site, we cannot guarantee product availability and products, nonetheless, may not be available for immediate delivery or delivery at all. We reserve the right without liability or prior notice, to revise, discontinue or cease to make available any or all products or to cancel any order. If there is any revision, discontinuance, or cessation, we may at our discretion, ship products that have substantially similar functionality and specifications to the products ordered or cancel your order.
